Article 1. Applicability 

1. These terms and conditions shall apply to all offers, order confirmations and agreements where Easy Tickets acts as the seller of tickets. The Dutch text of these terms and conditions is binding and rights cannot be derived from the translations. Additions to or deviations from these terms and conditions shall only apply if accepted in writing by Easy Tickets. No rights can be derived from any promises made by any Easy Tickets employee unless they have been confirmed in writing by Easy Tickets. 

2. General terms and conditions of buyers/customers shall not apply unless their applicability has been accepted explicitly in writing by Easy Tickets.  

Article 2. Definitions Easy Tickets: the company Easy Tickets (See Article 10 for more details). 

Ticket: admission ticket for an event. 

Buyer: the person who concludes an agreement with Easy Tickets to provide tickets (admission tickets) for events such as concerts, matches, etc. 

In writing: a letter put down on paper as well as a message that has been prepared and defined electronically. 

Order confirmation: a written confirmation provided by Easy Tickets of the order placed by the buyer regarding an order that is sent by Easy Tickets to the (e-mail) address specified by the buyer or that is issued to said buyer.  

Article 3. Agreement conclusion 

1. A Easy Tickets offer shall be deemed to have been accepted by the buyer should said buyer have specified in the Easy Tickets order form which ticket(s) said buyer wishes to receive as well as having filled in the other information and this order form has been received by Easy Tickets after it has been sent.  

2. A buyer shall also be deemed to have accepted a Easy Tickets offer if said buyer has passed on the required information through the phone to Easy Tickets. 

3. An agreement shall be concluded once Easy Tickets has confirmed the buyer's acceptance of a Easy Tickets offer through an order confirmation in writing. Easy Tickets shall not be obliged to conclude an agreement and can decide not to conclude an agreement at its own discretion. 

4. All orders are binding for the buyer and cannot be cancelled without written acceptance of cancellation by Easy Tickets.  

5. Easy Tickets has the right to cancell a order if there is one seating place left after an order.

Article 4. Prices 

1. Reselling is involved in relation to the sale of tickets by Easy Tickets. Easy Tickets prices will be different from the prices that may be specified on the tickets themselves and the buyer cannot derive any rights from these. All costs are included in Easy Tickets prices excluding shipment costs. 

2. Prices are expressed in euros unless otherwise specified.  

3. VAT cannot be specified on the invoice and/or the tickets as a result of Article 28b of the Wet Omzetbelasting (Dutch Sales Tax Act).  

Article 5. Payment 

1. Payment must be made by the buyer within three (3) days after the agreement has been concluded and the buyer shall be deemed to be in default in the event of failure to pay.  

2. Payment must take place using one of the methods specified on the Easy Tickets website or, as a departure from this, using a method to be further specified by Easy Tickets. 

3. Easy Tickets shall be entitled to dissolve the agreement if the buyer has not paid within three (3) days after the agreement has been concluded; this shall also apply when payment takes place after this term and before the invocation of the dissolution has taken place. 

Article 6. Delivery of tickets 

1. Easy Tickets aims at ensuring buyers receive tickets within seven (7) working days after concluding an agreement. Tickets for sporting event shall, however, usually be sent to the buyer approximately two (2) weeks before the event takes place.  

2. Shipment and issue shall be at the expense and risk of the buyer. 

3. Tickets shall be sent using the services of TNT within the Netherlands as a “recorded delivery”. Easy Tickets shall not be obliged to anything else than taking out insurance in accordance with the terms and conditions as applied by TNT for a value of no more than € 46,-. If in deviation to the above tickets are sent within the Netherlands through FedEx or through a similar courier service, the provisions shall apply as if the tickets were being sent to an international address. 

4. Should an insured shipment be lost or missing, the buyer may make a claim for payment from Easy Tickets in relation to the amount that Easy Tickets can obtain in compensation from TNT as a result of the insured value up to a maximum of € 46,-. 

5. Should TNT not be able to personally deliver the tickets, said company shall be sent to the nearest post office where the tickets shall remain for two (2) weeks. TNT shall ensure there is a written notification at the order address in relation to this.  

6. Tickets shall be sent at the expense and risk of the buyer via FedEx or a similar courier service in relation to addresses outside the Netherlands.  Shipments by FedEx are not insured. Easy Tickets cannot be held liable for any damage should FedEx lose and or misplace tickets.  

7. The tickets shall be delivered by FedEx at the address as specified by the buyer unless nobody is available to receive them. FedEx will leave written notification should this be the case that shall list the telephone number of the nearest FedEx office. The buyer can next make an appointment to ensure the tickets can be obtained. 

8. Should the buyer not accept, pick up or have picked up a ticket sent to said buyer, and the ticket is returned to Easy Tickets by TNT or FedEx, the buyer shall be deemed to be waiving his or her right to delivery. The buyer shall be obliged to compensate Easy Tickets for the costs incurred in relation to the return shipment. 

9. Easy Tickets may choose a different delivery method than specified above, for example, by having the tickets delivered to the reception of a hotel specified by the buyer or user, in deviation to the provisions related to delivery.  

Article 7. Special provisions and liability 

1. When the occasion arises and in particular in relation to music and/or sporting events, tickets may display a name that does not match the name of the buyer or user of the ticket. Easy Tickets cannot be held liable should the buyer and/or the user of a ticket not be granted access to the event and/or he or she (and/or the person for whom said buyer has bought the ticket(s)) is denied access as a consequence of this.  

2. The buyer and/or the user of a ticket supplied by Easy Tickets must behave as a good and orderly visitor of events and must follow instructions given by or due to the organiser of an event to be visited by said buyer and/or user as well as by the competent authorities. 

3. Easy Tickets shall not be held liable should organisers of an event or the authorities deny admission to the buyer and/or user of a ticket delivered by Easy Tickets to an event except insofar this is due to an intentional act or omission or gross negligence of Easy Tickets. 

4. The buyer and/or user of a ticket shall visit an event at his or her own risk. Easy Tickets shall not be held liable for damages that the buyer and/or user may suffer while travelling from or to the event or attending such an event.  

Easy Tickets retains the right to upgrade tickets without incurring further costs or obligations on its part.  

5. The Buyer and/or user of a ticket supplied by Easy Tickets must obtain information himself or herself in relation to instructions given by or on behalf of the organiser of the event or the authorities as well as changes with regard to the event such as starting times and similar. Easy Tickets shall not have any obligation to further inform the buyer and/or user of the ticket regarding this. 

6. Events that have been cancelled or moved are at the expense and risk of the buyer and cannot be regarded in any way as a shortcoming of Easy Tickets. Easy Tickets shall not be liable to pay for compensation. 

7. Should an event be cancelled and should a replacement event not take place, the buyer must not approach Easy Tickets but the organiser of the event in order to be refunded the original value of the ticket if possible.  Should a replacement event take place, the buyer must approach the organiser of the event should said buyer not be able to be present at the replacement event in order to be refunded the original value of the ticket if possible.  

8. The content of the Easy Tickets website is without obligation and the buyer cannot derive any rights towards Easy Tickets in relation to the content thereof and the included links.  

9. Easy Tickets prices are subject to fluctuations related to the demand for and the availability of tickets. The buyer cannot derive any rights from increases or reductions of prices once the buyer has accepted a Easy Tickets offer. 

10. Any liability of Easy Tickets shall be limited to the amount that the buyer has paid for the ticket involved. 

Article 8. Force majeure 

1. Shortcomings in relation to the execution of the agreement cannot be attributed to a party should these not be due to the fault of the party or when said party cannot be deemed responsible for them in accordance with the law, the agreement or according to generally accepted standards. 

2. Easy Tickets can invoke force majeure should the Easy Tickets shortcoming be partly or fully the result of war, mobilisation, riots, flooding, fire, accidents, strikes, occupations, measures set by the government, non-delivery of required tickets to Easy Tickets by third parties and other unforeseen events. 

3. Should Easy Tickets be unable to deliver one or more tickets to the buyer due to force majeure, Easy Tickets must refund the buyer the price that said buyer has paid for the ticket(s).  

Artikel 9. Brochure (Web) of Easy Tickets 

1. The information stated in the brochure is subject to changes due to price changes and/or errata. Amounts mentioned on the website are based on prices, exchange rates, duties and taxes as they are known by Easy Tickets at the time of its printing.

Article 10. Information from and about Easy Tickets 

1. Easy Tickets has registered offices in Alphen aan den Rijn (postcode 2408 DS), Aristoteleslaan 11 and has been registered in the Registry of Companies under number 28104875.  

2. Easy Tickets is a commercial company specialised in offering tickets for sold-out and/or popular events and for so-called hard-to-get tickets.  

3. Easy Tickets is not associated to any official point of sale or organiser.  

Article 11. Applicable law 

This agreement shall be governed by Dutch law. Insofar as deviating from statutory jurisdiction rules is allowed, the competent court shall examine all disputes that may occur between Easy Tickets and the buyer within the District of ‘s-Gravenhage unless Easy Tickets should prefer to submit the dispute to the competent court in the city where the buyer resides.
